These Terms of Use ("Terms") govern your use of the HabitHouse mobile app, the habithouse.app website, and our email waitlist. Please read them. Our Privacy Policy explains how we handle your data.
By downloading, accessing, or using HabitHouse, you agree to these Terms. If you don't agree, please don't use HabitHouse. If you're using HabitHouse on behalf of someone else, you confirm you're authorized to accept these Terms for them.

HabitHouse is a habit-building app with AI coaches (Brock and Luna) that help you set up habits, check in daily, and talk things through by chat or voice. Features may change, launch, or be removed as we develop the product.
You must be at least 13 years old to use HabitHouse. If you are under the age of majority where you live, you may only use HabitHouse with the involvement of a parent or guardian who agrees to these Terms. In some countries the minimum age for consenting to online services is higher than 13, and you must meet whatever age your country sets.
An AI coach may not be suitable for every minor. The coaches hold open-ended conversations, and a younger user may not always keep in mind that they're talking to software. Parents and guardians should look at the app with their teenager before they use the coach.
When you first open the app, we create an anonymous account for you automatically. You can later add an email address and password to create a full account. You're responsible for the activity under your account and for keeping your login details secure. Let us know at hey@habithouse.app if you believe your account has been used without your permission.
Brock and Luna are artificial intelligence. They are not real people, and no human is reading or answering your conversations. They are fictional characters with written personalities, and every reply you receive — typed or spoken — is generated by an AI model. They will stay in character while you talk to them, but if you ever ask directly whether you are speaking with a real person, you will be told plainly that you are not. Our AI and safety page explains how this works.
Your coach offers general habit, motivation, and productivity support for informational purposes only. It is not a substitute for professional medical, mental-health, psychological, financial, legal, or other professional advice, and you should not rely on it for those decisions. AI responses can be inaccurate, incomplete, or not right for your situation — use your own judgment. Any habit verification drawn from Apple Health is a convenience, not a medical measurement, and should never be used to make a health decision.
Using HabitHouse does not create a doctor-patient, therapist-client, or any other professional relationship. If you are experiencing a medical or mental-health emergency, contact a qualified professional or your local emergency services. If you are in crisis in the United States, you can call or text 988 (Suicide & Crisis Lifeline). Outside the US, contact your local crisis line or emergency number. Your coach is not a crisis service and must never be relied on as one.
HabitHouse may offer paid subscriptions and features. If you purchase one, it is sold and billed through the Apple App Store, and your Apple account is charged. Paid subscriptions may auto-renew: unless you cancel at least 24 hours before the end of the current period, the subscription renews and your Apple account is charged for the next period. You can view, manage, or cancel a subscription any time in your device's Settings → [your name] → Subscriptions. Payment is charged to your Apple account at confirmation of purchase. Prices and features may change; for an existing subscription, a price change takes effect no earlier than your next renewal and is subject to Apple's notice and consent process. Purchases are also subject to Apple's terms, and refunds are handled by Apple.
What a paid plan includes. A paid plan includes coach chat and a monthly allowance of coach voice-call minutes, which resets at the start of each calendar month and does not roll over. If you use up the monthly allowance, you can buy additional minutes as a separate one-time purchase; purchased minutes are drawn on only after the monthly allowance is exhausted, are always sold at their standard price, and are not refundable except as required by law or by Apple. We may change the size of the allowance for future periods, and we'll tell you before a change takes effect.
Founding membership. We may offer a limited number of founding memberships at a reduced price during a launch window. If you buy one, that reduced price is the ongoing price of that plan for as long as your subscription stays active, and it is not a temporary discount that expires. Founding memberships are limited in number and available only while the launch window is open; once the spots are taken or the window closes, the offer ends and cannot be reopened for you. The membership is tied to your account and is not transferable. If you cancel and later resubscribe to the same founding plan while it remains available to you, your founding price continues; additional minute packs are always charged at the standard price. As with any subscription, Apple must approve and notify you of any future price change, and you can decline it.
You keep ownership of the content you create in HabitHouse — your habits, logs, notes, messages, and any photos you attach. You grant us a limited license to store, process, and display that content to operate, provide, secure, and improve HabitHouse for you, which includes sending the messages you send to your coach to the third-party AI providers that generate coach responses, and generating coach memory and summaries from your conversations, as described in our Privacy Policy. You're responsible for your content and confirm you have the right to share anything (including photos) you upload.
When using HabitHouse, you agree not to:
HabitHouse is a private, single-user app: the photos and text you put into it are visible to you and are not published, shared with other users, or made available to the public. Even so, we respect copyright and will act on valid complaints.
If you believe material in HabitHouse infringes your copyright, send a notice to our designated agent at hey@habithouse.app with the subject line "DMCA Notice," including: your physical or electronic signature; identification of the copyrighted work you say is infringed; identification of the material and enough detail for us to locate it; your address, telephone number, and email; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner. We will remove or disable material we determine to be infringing, and we may terminate the accounts of repeat infringers. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address.
HabitHouse — including the app, website, the HabitHouse name and brand, the coach characters (Brock and Luna), and all related content other than your own content — is owned by Better Human Labs LLC and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use HabitHouse for your own personal use. You may not copy, modify, distribute, sell, or create derivative works from HabitHouse without our permission.
HabitHouse relies on third-party services (including Apple and the service providers listed in our Privacy Policy). Your use of those services may also be governed by their own terms, and we are not responsible for third-party services.
These Terms are an agreement between you and Better Human Labs LLC, not with Apple Inc. ("Apple"), and Apple is not responsible for HabitHouse or its content. Apple has no obligation to provide any maintenance or support for HabitHouse. Apple is not responsible for addressing any claims by you or a third party relating to HabitHouse, including product-liability claims, claims that HabitHouse fails to conform to any legal or regulatory requirement, consumer-protection claims, or claims that HabitHouse infringes a third party's intellectual-property rights. You represent that you are not located in a country subject to a U.S. Government embargo or that has been designated a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You can stop using HabitHouse at any time and delete your account from Profile → Delete account in the app. We may suspend or end your access if you violate these Terms or if we need to for legal, security, or operational reasons. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
HabitHouse is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't guarantee that HabitHouse will be uninterrupted, error-free, or secure, or that using it will produce any particular result or outcome.
To the maximum extent permitted by law, Better Human Labs LLC and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of HabitHouse. To the extent liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim or US $50.
You agree to indemnify and hold harmless Better Human Labs LLC from claims, damages, and reasonable expenses (including legal fees) arising from your content, your violation of these Terms, or your violation of any law or the rights of a third party in connection with your use of HabitHouse.
If you join our email waitlist by submitting your email address on our website, you agree to receive email updates from HabitHouse. This is an active opt-in — your email is never added without you submitting it. You may receive a confirmation, a launch notification, offers and discount codes (eligibility may vary), and occasional product news. Every email includes a one-click unsubscribe link, and you can opt out at any time.
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above, and significant changes may also be communicated in the app or by email. Your continued use of HabitHouse after a change means you accept the updated Terms.
If you have a problem with HabitHouse, email hey@habithouse.app and describe it. Most things get fixed this way. Before either of us starts a formal proceeding, we each agree to give the other written notice of the dispute and 60 days to resolve it informally. This step is a real condition, not a formality, and either of us can ask a court or arbitrator to enforce it.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your case. It applies to you if you live in the United States.
Binding arbitration. If we can't resolve a dispute informally, you and Better Human Labs LLC agree that any dispute, claim, or controversy arising out of or relating to HabitHouse or these Terms will be settled by binding individual arbitration, rather than in court. This is governed by the Federal Arbitration Act. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, by a single arbitrator. The arbitrator decides the dispute and the award may be entered as a judgment in any court with jurisdiction. Arbitration is less formal than a lawsuit: there is no judge or jury, discovery is more limited, and review of the award is very limited.
Where and how. You may choose to have the arbitration conducted by telephone, by videoconference, based on written submissions only, or in person in the county where you live. We will not seek to make you travel.
Costs. The AAA Consumer Arbitration Rules govern the fees. Where those rules require you to pay a filing fee, we will pay it for you for any claim under $10,000 unless the arbitrator finds your claim frivolous. Each side otherwise bears its own attorneys' fees unless a law or the arbitrator says otherwise.
Class-action waiver. You and we agree that each of us may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, coordinated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party's individual claim. You and we also waive any right to a jury trial.
What is not covered. Either of us may bring an individual claim in small-claims court if it qualifies, and either of us may seek injunctive or equitable relief in court to stop infringement or misuse of intellectual property. Nothing here prevents you from reporting a concern to a government agency, and claims that cannot lawfully be arbitrated or waived are excluded.
How to opt out. You can decline arbitration and the class-action waiver with no effect on the rest of these Terms. Email hey@habithouse.app with the subject line "Arbitration Opt-Out" and include your name and the email or account you use, within 30 days of first accepting these Terms (or within 30 days of the date we publish a change to this section). If you opt out, disputes go to the courts identified below. Opting out will never affect your access to HabitHouse or how we treat you.
Severability. If the class-action waiver above is found unenforceable as to a particular claim or a particular request for relief, that claim or request is severed and must proceed in court, while every other claim proceeds in arbitration. If the whole arbitration agreement is found unenforceable, the rest of these Terms still apply.
If you are outside the United States. This section does not apply to you if the law where you live does not permit it. Consumers in the European Economic Area and the United Kingdom keep their rights to bring proceedings in their local courts and to use their national alternative dispute resolution and consumer-protection schemes, and nothing in these Terms takes away a right your local consumer law gives you that cannot be waived.
Better Human Labs LLC is organized in the State of California, and these Terms are governed by California law, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration — because you opted out, because it falls in a carve-out, or because arbitration is found not to apply — you and we agree to the exclusive jurisdiction of the state and federal courts located in California, and each of us consents to personal jurisdiction there. Nothing in this section limits your right to bring a qualifying claim in your own local small-claims court.
If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the place where you live. In particular, if you are a consumer in the European Economic Area or the United Kingdom, you keep the protection of your national law and your right to bring proceedings in your local courts, and if you are a California consumer, nothing here waives any right you have under California consumer-protection law that cannot be waived.
These Terms (together with our Privacy Policy) are the entire agreement between you and us about HabitHouse. If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
